ONDO GOVERNORSHIP 2020:SUMMARY OF TRIBUNAL UPDATES

 





PDP CASE:

1. Eyitayo Jegede (SAN) told the Tribunal that:

*. Rotimi Akeredolu (SAN) was not validly nominated by APC as the Governorship Candidate as the Governor of Yobe State who is the National Caretaker Chairman of APC Mai Bala Buni could not also function and conduct the APC Governorship Primary that produced Rotimi Akeredolu. 

*. He said Rotimi Akeredolu's nomination ran contrary to APC Constitution, Electoral Act 2010 as amended, and the 1999 Constitution of the Federal Republic of Nigeria as amended.

2. The evidence and documents rendered by Eyitayo Jegede and PDP were admitted by the Tribunal as exhibits.(This included the APC Constitution).

3. Eyitayo Jegede faulted the collation of the election results by the INEC.

4. Eyitayo Jegede was the first and only witness for PDP. Eyitayo Jegede and PDP closed case without using 399 other witnesses.


INEC DEFENCE:

1. Form EC9B received on 28/7/2020 from APC was relied upon.

2. INEC confirmed that a registered political party can appoint a Caretaker Committee in as much it is in line with the Constitution.

3. INEC admitted that in sponsoring a candidate, the party shouldn't infringe on the 1999 Constitution because it is superior.

4. INEC confirmed it has no right to reject a nomination from a political party on no condition.

5. INEC confirmed that the letters of a political party must be signed by his National Chairman and National Secretary wherein, the National Chairman is the Executive of the party and Governor Mai Bala Buni Governor of Yobe State performed the function of the Chief Executive of APC and it was on the status of the Chairman and Secretary that all the Forms were submitted to INEC.

6. INEC confirmed Mai Mala Buni as the Chief Executive of APC and the correct person to sign the B21 Form.


APC DEFENCE:

1. APC presented only a witness in addition to the evidence already tendered before the Tribunal.

2. APC, Akeredolu, Aiyedatiwa made disclosure of the appointment of Mai Buni Governor of Yobe State, as the National Caretaker Chairman of APC.

3. APC, Akeredolu and Aiyedatiwa affirmed the supremacy of the 1999 Constitution of the Federal Republic of Nigeria over any political party Constitution.

4. APC, Akeredolu and Aiyedatiwa announced the close of defence for evidence-in-rebuttal.


TRIBUNAL:

1. The Tribunal adjourned and fixed February 25, 2021 for adoption of final written addresses by all the parties involved in the case.
